Ministerial statement on neighbourhood planning under threat

A group of 18 claimants have threatened to launch a legal challenge to overturn the government’s move to strengthen neighbourhood plans in areas where the locals authority does not have a five-year land supply.

The written ministerial statement (WMS) on neighbourhood planning made by planning minister Gavin Barwell on 12 December changes the national policy in NPPF (paragraph 49] removing the requirements for every local planning authority in the country to demonstrate a five-year supply of housing land.

Among the five grounds of challenge, the developers claim that the government has unlawfully introduced a major change of policy without any prior consultation.
